Literal vs Doctrine of Equivalents Analysis
Literal infringement requires that every element of a claim be present in the accused product exactly as claimed. For each claim element, we identify whether the product's corresponding feature satisfies the element literally — and document the specific technical evidence for each finding. Where literal infringement is not present, we assess the Doctrine of Equivalents — whether the product's implementation is substantially similar (performs substantially the same function in substantially the same way to achieve substantially the same result) to the claimed element.
